Why should I mediate my dispute?

Mediation is a voluntary process in which you and the other party try to find a mutually agreeable solution, using the services and expertise of a neutral mediator. The mediator helps guide the negotiation process and suggest alternative solutions to both parties. The mediator helps you propose and think about resolutions, and will neither try to determine right or wrong nor dictate a solution.

This ensures that the process is always under your control, and is much quicker and less expensive than other alternatives such as going to court. Mediation is also required in your Residential Purchase Agreement:

"Buyer and Seller agree to mediate any dispute or claim arising between them out of this agreement, or any resulting transaction, before resorting to arbitration or court action…"

California Residential Purchase Agreement; Clause 17.
